Terms of Service

Please read these Terms of Service ("Terms") carefully before using the MyGuyPro mobile application and related services (the "Service") operated by MyGuyPro LLC ("MyGuyPro," "we," "us," or "our"). By creating an account or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Definitions

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By registering, you represent that you are 18 or older, have legal capacity to enter into a binding contract, and that all information you provide is accurate and complete.

The Service is not available to users previously suspended or removed from the platform.

3. The MyGuyPro Platform — Independent Contractor & Vetting Disclaimer

MyGuyPro is a neutral marketplace platform that connects clients with independent service professionals ("Pros"). MyGuyPro does not employ Pros, is not a party to any service agreement between a client and a Pro, and is not responsible for the quality, safety, legality, or outcome of any services rendered.

Independent Contractor Relationship: All Pros who list on MyGuyPro are independent contractors — either sole proprietors operating their own businesses or licensed/credentialed professionals representing themselves on the platform. They are not employees, agents, partners, joint venturers, or franchisees of MyGuyPro LLC in any capacity. MyGuyPro does not supervise, direct, or control the work performed by any Pro, and is not responsible for any acts, omissions, injuries, damages, losses, costs, or liabilities arising from services performed by a Pro. Any agreement for services is solely between the client and the Pro.

Eligible Professional Categories: MyGuyPro welcomes licensed or credentialed professionals across a broad range of categories, including but not limited to: home services (plumbers, electricians, HVAC technicians, general contractors, painters, roofers); legal professionals (attorneys, paralegals, notaries); financial professionals (financial advisors, CPAs, accountants, tax professionals, insurance brokers, mortgage brokers); health and wellness professionals (personal trainers, nutritionists, therapists, coaches); and creative and technology professionals (photographers, web developers, consultants, IT specialists).

Firm-Affiliated Professionals: MyGuyPro also welcomes professionals who work under or are affiliated with a credible company or firm — such as an attorney at a law firm, a financial advisor at a wealth management company, or an electrician working for a licensed contractor. In all cases, the MyGuyPro profile and reputation belong to the individual professional who created the account, not the business or firm. The Pro's reputation on the Platform is independent of their employer or firm affiliation. Pros are solely responsible for complying with all applicable local, state, and federal laws, including licensing, bonding, insurance, and tax obligations relevant to their trade or profession. MyGuyPro does not verify, warrant, or guarantee that any Pro holds any particular license, certification, insurance policy, or bond.

The "Verified Pro" badge indicates that the Pro is enrolled in a paid MyGuyPro subscription tier (Pro or Premier Pro) and has been reviewed and approved by the MyGuyPro team through our internal vetting process for inclusion in the marketplace. The badge is not a guarantee of current licensing, current bonding, current insurance coverage, work quality, project outcome, or fitness for any particular purpose. Clients are solely responsible for independently verifying a Pro's credentials, license status with the relevant state board, and active insurance coverage with the relevant carrier before engaging the Pro for any project where those facts are material to the decision. MyGuyPro expressly disclaims any liability arising from a client's reliance on badge status alone.

Self-Reported Credentials. Pros may, at their option, enter professional-license information (license number, issuing jurisdiction, and expiration date) and liability-insurance information (carrier name, policy number, and expiration date) into their MyGuyPro profile. Any such information is self-reported by the Pro and is displayed on the public profile with a corresponding disclaimer. MyGuyPro does not independently verify, validate, certify, or warrant any self-reported credential against the issuing state licensing board, the insurance carrier, or any other third-party authority. The Pro is solely responsible for the accuracy, completeness, currency, and validity of any credential they self-report. Clients should treat self-reported credentials as a starting point only and independently confirm any license number with the issuing state board (public lookup tools are typically free) and any insurance policy with the carrier before relying on it.

Special professional categories. For attorneys, financial advisors, accountants, tax professionals, and similar regulated practices: the MyGuyPro Platform is not a substitute for the formation of a formal professional relationship with the Pro. Contacting a Pro through MyGuyPro does not, by itself, create an attorney-client relationship, an advisor-client relationship, or any other professional relationship, and no information exchanged through the Platform is protected by attorney-client privilege or any other professional privilege unless and until a separate, formal engagement is signed between you and the Pro. MyGuyPro does not endorse any Pro's professional advice, investment recommendations, or legal opinions.

4. Subscription Tiers, Billing, and Auto-Renewal

MyGuyPro offers optional subscription plans for Pros: Essential (free), Pro, and Premier Pro. These subscriptions are business-marketplace listing services — they grant a Pro enhanced visibility, search ranking, listing capacity, and trust-badge eligibility on the MyGuyPro Platform. They are not consumer entertainment or in-app digital content; they are operating expenses for an independent service professional choosing to advertise their availability through our marketplace, comparable to listings on other professional-services platforms.

Where you subscribe. Paid subscriptions are purchased and managed on the MyGuyPro website at myguypro.app. Billing is processed by Stripe, Inc. through Stripe-hosted Checkout. MyGuyPro does not see, transmit, or store your payment card number. The iOS app does not sell subscriptions; it provides read-only visibility into your current tier.

Auto-Renewal Disclosure. Paid subscriptions automatically renew at the end of each billing period (monthly or annual, as you select) unless you cancel before the renewal date. The payment method on file with Stripe will be charged the then-current subscription price at confirmation of purchase and at the start of each renewal period. To manage your plan, update your payment method, switch billing intervals, or cancel, sign in at myguypro.app/account and use the Manage billing button to access the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date.

Promotional codes. From time to time, MyGuyPro may issue promotional codes that grant a temporary discount on a paid subscription. Codes are redeemable in checkout, are subject to the terms displayed at the time of redemption, and cannot be exchanged for cash or combined with other offers unless explicitly stated.

Subscription prices may change. Active subscribers will receive at least 30 days' advance notice via email before any price increase takes effect, and may cancel before the new price applies.

5. Refund Policy

All subscription fees are non-refundable to the fullest extent permitted by law. If you cancel, you retain access to paid features until the end of your current billing period; no prorated refund is issued for the unused remainder of that period.

If you believe you were charged in error, contact support@myguypro.app within 30 days of the charge with the invoice number from your Stripe Customer Portal. We review billing disputes case-by-case and may issue a refund at our discretion or, where appropriate, process the refund directly through Stripe. For credit-card chargebacks, please contact us first; chargebacks initiated without prior notice may result in account suspension pending resolution.

6. Prohibited Conduct

You agree not to:

MyGuyPro is an inclusive platform. You agree not to discriminate against, harass, or refuse service to any user based on race, color, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic. Our "I know a guy / gal / pro" branding reflects a commitment to welcoming all professionals and clients equally.

Violations may result in immediate account suspension or termination without refund.

7. Intellectual Property

The Service and its content are owned by MyGuyPro LLC and protected by intellectual property laws. You may not reproduce or distribute any part of the Service without prior written consent.

By submitting content (profile info, photos, reviews, messages), you grant MyGuyPro a non-exclusive, royalty-free license to use, store, display, and distribute that content solely for operating and improving the Service.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, MyGuyPro LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or damages from services performed by any Pro. Our total liability shall not exceed the greater of fees you paid in the 12 months before the claim or $100.

9. Indemnification

You agree to defend, indemnify, and hold harmless MyGuyPro LLC from any claims, liabilities, and expenses arising from your use of the Service, violation of these Terms, violation of third-party rights, or any content you submit.

10. Dispute Resolution and Binding Arbitration

Please read carefully — this affects your legal rights.

You and MyGuyPro agree to resolve disputes through binding individual arbitration administered by the AAA under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: YOU AND MYGUYPRO EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Informal Resolution First: Contact us at support@myguypro.app and give us 30 days to resolve the dispute informally before initiating arbitration.

Opt-Out: You may opt out within 30 days of first accepting these Terms by emailing support@myguypro.app with subject "Arbitration Opt-Out."

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Non-arbitrable disputes shall be brought exclusively in the state or federal courts of Texas.

12. Termination and Account Deletion

Self-service deletion (in app). You may delete your account at any time directly in the mobile app: Settings → Delete Account. This permanently removes your profile, bookings, in-app messages, notifications, and authentication credentials. Active Stripe subscriptions are cancelled in the same operation. Reviews you have authored are anonymized (your name is removed) but the rating you gave the Pro remains visible on their profile.

Email deletion request. You may also request deletion by emailing support@myguypro.app from the address on file. We will action verified requests within 30 days.

What is retained after deletion. Financial transaction records (Stripe charges, refunds, transfers) are retained for up to 7 years for tax and accounting compliance. Reviews you authored remain visible without your name. See the Privacy Policy Section 5 for the full retention table.

Termination by MyGuyPro. MyGuyPro may suspend or terminate your account for any violation of these Terms (Section 6 — Prohibited Conduct). Paid subscription fees are non-refundable upon termination for cause.

Open bookings. Deletion is blocked while you have any booking that has not reached a terminal state. Terminal (deletion-eligible) states are: confirmed, completed, cancelled, refunded, expired, declined, resolved_refunded, and already_refunded. Any booking in another status — including requested, quoted, accepted, in_progress, pending_confirmation, or disputed — must be resolved before we can complete the deletion. This protects the counter-party from being stranded mid-transaction and prevents us from orphaning escrowed funds.

13. Copyright Policy & DMCA Procedure

MyGuyPro respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe content posted on the Service infringes a copyright you own or are authorized to enforce, please send a written DMCA notice to our Designated Copyright Agent at the address below.

Registration of this agent with the U.S. Copyright Office is in process. In the interim, the contact information above is the published designated agent contact; both email and postal notices are accepted and acted upon.

Required contents of a DMCA notice (17 U.S.C. § 512(c)(3)). Your notice must include all of the following or we cannot act on it:

What we do with valid notices. Upon receipt of a complete notice we will, in our discretion and within a reasonable time, (i) remove or disable access to the allegedly infringing material, (ii) notify the user who posted it, and (iii) provide that user a copy of the takedown notice. False or bad-faith notices may subject you to liability under 17 U.S.C. § 512(f).

Counter-Notice procedure. If you are the user whose content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice to dmca@myguypro.app containing:

We will forward complete counter-notices to the original complainant. If the complainant does not provide us with notice that they have filed a court action seeking a restraining order against the user within 10–14 business days of our forwarding the counter-notice, we will restore the material in accordance with 17 U.S.C. § 512(g).

Repeat-infringer policy. Consistent with the DMCA and other applicable law, MyGuyPro will terminate, in appropriate circumstances and at our discretion, accounts of users that we determine to be repeat copyright infringers. We may also terminate accounts of users for a single instance of clear copyright infringement in our sole judgment.

14. Changes to These Terms

We will notify you of material changes via the app or email at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
